What happened
The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. This was the second LTB application for non-payment within a year. The Tenant admitted to the arrears but cited significant immigration legal fees as the reason for falling behind. While the Tenant sought a payment plan, the Landlord pushed for termination due to repeat issues and NSF payments.
The ruling
The tenancy is terminated effective October 3, 2025, unless the Tenant voids the order by paying the specified arrears ($4,565.00 by Aug 31, or $6,809.75 by Sep 30, or $9,054.50 by Oct 3). If the Tenant fails to void the order, they must move out by October 3, 2025, and pay the Landlord $1,322.49 plus daily compensation of $73.80.
