What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant requested a review of the original order, stating she was unable to attend the initial hearing due to technical issues. The Landlord objected to the review request.
The ruling
The Tribunal granted the Tenant's request to review the original order, finding that the Tenant was not reasonably able to participate in the initial hearing due to technical issues. The matter was then heard de novo. The Tribunal determined that the Tenant was in arrears of over $15,000 in rent, and that the Tenant did not have sufficient income to continue paying the lawful rent and make timely repayments on the arrears. While the Tribunal could not grant a conditional order, it postponed the eviction until October 6, 2024 to allow the Tenant more time to either void the order or find alternative housing.
