What happened

The Landlord applied for termination and eviction based on non-payment of rent and persistent late payment. The Tenant failed to attend the hearing, citing work commitments. Evidence showed significant rent arrears and unpaid utilities that the Tenant was responsible for under the lease agreement. The Landlord also noted that the Tenant had previously breached a repayment plan in a prior tenancy elsewhere.

The ruling

The LTB ordered the termination of the tenancy unless the Tenant pays $7,186.00 by November 30, 2025, or $8,586.00 by December 2, 2025. If the Tenant fails to pay, she must vacate by December 2, 2025. Regardless of eviction, the Tenant is ordered to pay utility arrears of $1,670.88 and total rent arrears/costs amounting to $8,331.45 up to the hearing date.
