What happened
Landlords applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had informed the Landlords that she would vacate the rental unit on or before March 31, 2023.
The ruling
The tenancy will be terminated on April 30, 2023 unless the Tenant pays $19,395.48 to void the order and continue the tenancy. If the tenancy is terminated, the Tenant must pay $14,306.64 to the Landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenant must also pay daily compensation of $57.12 for each day of occupation starting March 3, 2023 until the Tenant vacates the unit.
