What happened
The Landlord applied to terminate the tenancy and evict the Tenants for non-payment of rent. Although the Tenants paid $6,000.00 after the application was filed, a balance of $600.00 in arrears remained as of the hearing date. One tenant briefly attended the videoconference but disconnected and did not return. The Board found that the N4 notice was valid and that the Tenants did not void it before the application was filed.
The ruling
The tenancy is terminated effective August 26, 2025, unless the Tenants pay $3,861.00 to void the order. This amount includes arrears, the filing fee, and August rent. If the Tenants vacate, the Landlord is ordered to pay the Tenants $2,346.74, which represents the surplus of the rent deposit and interest after covering the outstanding arrears and fees, minus daily compensation for occupancy in August.
