What happened

The Landlord applied for an order for rent and compensation after the Tenant vacated the rental unit without proper notice before the end of a fixed-term lease. The Tenant requested an adjournment claiming he was not served with the application, but this was denied because the Tenant had access to the application via the Tribunals Ontario Portal and had engaged in online dispute resolution. The Board found the Landlord made reasonable efforts to mitigate losses by advertising the unit promptly after the Tenant abandoned it.

The ruling

The Tenant is ordered to pay the Landlord $5,354.43 by November 30, 2025. This amount includes rent arrears and compensation for lost rent due to the Tenant abandoning the property before the lease term ended, minus the rent deposit and interest. The Landlord successfully demonstrated reasonable mitigation of losses.
