What happened

The Landlord applied for eviction based on allegations that the Tenant's rental unit produced a 'putrid' odour of pet urine and feces, which was so severe that staff had to evacuate the office for five days. Additionally, the Tenant was accused of harassing staff members, leading to a police call, and violating local bylaws by keeping more than three dogs (specifically five adults and several puppies) in the unit.

The ruling

The Board issued a conditional order allowing the tenancy to continue provided the Tenant meets specific requirements: professional remediation of the odour by November 30, 2025; maintaining ordinary cleanliness and following pet bylaws until October 31, 2027; and refraining from yelling at or loudly arguing with staff. Failure to comply allows the Landlord to apply for an ex parte eviction order under section 78. The Tenant must also pay the $186.00 application fee.
