What happened
The Landlord applied for eviction after the Tenant allegedly breached conditions of a previous order. An order was subsequently issued without a hearing. The Tenant filed a motion to set aside that order. At the hearing for the motion, both parties reached a consent agreement where the Tenant acknowledged arrears and committed to a structured payment plan to maintain the tenancy.
The ruling
The LTB granted the Tenant's motion to set aside a previous eviction order based on a consent agreement between the parties. The Tenant is ordered to pay $8,425.40 in arrears through a monthly installment plan ending in December 2025. The Tenant must also pay current rent in full. Failure to meet any payment allows the Landlord to apply for an eviction order without further notice.
