What happened

The Landlord, a real estate holdings company, applied to terminate the tenancy and evict the Tenant for non-payment of rent and to recover fees for NSF cheques. The Tenant did not attend the scheduled videoconference hearing. The Landlord's agent provided evidence that the Tenant had made partial payments but an outstanding balance remained. The Landlord had also attempted to arrange a payment plan, but the Tenant was unresponsive.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying the Landlord $2,304.80 by June 13, 2025. If the Tenant does not pay and vacates, the Landlord must pay the Tenant $1,737.38, which is the balance of the rent deposit and interest after deducting rent arrears, NSF fees, and the application fee. This amount will be adjusted by a daily compensation of $64.44 for each day the Tenant occupies the unit after May 29, 2025. The Landlord can file for eviction with the Sheriff on or after June 14, 2025, if the order is not voided.
