What happened
The tenant, who rented a room in a house, filed an application against the landlord. The tenant alleged that the landlord's installation of security cameras in the common areas (kitchenette) constituted an illegal entry and a substantial interference with his reasonable enjoyment of the unit. The tenant also claimed harassment over a late rent payment inquiry. The tenant moved out due to these issues and sought a rent abatement and rent differential.
The ruling
The Tenant's application regarding illegal entry and substantial interference due to the installation of cameras in common areas and alleged harassment was dismissed. The LTB found that the Tenant had no reasonable expectation of privacy in the shared kitchen of a rooming house and that the Landlord's reasons for installing the cameras (security concerns over unauthorized occupants) were valid. The Landlord's actions regarding visits and rent inquiries were also deemed reasonable.
