What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant for non-payment of rent. During the hearing, the Tenant's Legal Representative raised a jurisdictional issue regarding a fatal defect in the N4 notice, specifically that the rent charged, rent paid, and rent owing were incorrect. The Landlord's representative did not dispute the error and chose to withdraw the application.
The ruling
The application is dismissed as withdrawn. The Landlord withdrew the application after it was determined that the N4 notice contained a fatal error regarding the rent amounts. The Landlord retains the right to serve a new N4 notice and file a new application.
