What happened
The Landlord applied to terminate the tenancy due to significant rent arrears. The Tenant requested a review of a previous eviction order, claiming she never received notice of the original hearing. While the review was granted and the case heard de novo, the Tenant was unable to prove her claims of having paid rent in cash and could not provide an accurate accounting of what she owed. The Landlord's claim exceeded the LTB's monetary jurisdiction, but he chose to proceed with the application at the Board.
The ruling
The LTB granted the Tenant's review request but ultimately upheld the eviction. The tenancy is terminated unless the Tenant pays $36,186.00 by July 31, 2025. If the Tenant does not void the order, she must move out by August 2, 2025, and pay the Landlord $34,859.44, representing the maximum amount allowable under the Board's jurisdictional limit for rent arrears and filing costs up to the hearing date.
