What happened
The Landlord applied to terminate the tenancy because the Tenant failed to prepare for pest control treatments for a cockroach infestation on multiple dates. The Tenant requested a review of a previous order, claiming medical conditions and the death of a roommate prevented his participation and compliance. While the review was granted and the previous order cancelled, the new hearing resulted in the termination of the tenancy because the Tenant continued to interfere with necessary maintenance by failing to follow preparation instructions.
The ruling
The LTB granted the Tenant's request for a review and cancelled the previous order. However, upon rehearing the merits, the Board terminated the tenancy effective December 31, 2025. The Tenant was found to have substantially interfered with the Landlord's maintenance by failing to prepare for cockroach treatments, causing the infestation to spread to other units. The Landlord is ordered to apply the $859.35 held for rent deposit and interest toward the filing fee and future occupation charges.
