What happened
The Landlord applied for an order to determine whether the Residential Tenancies Act, 2006 applies to the living arrangement. The Tenant occupied a room in the Landlord's house and shared the kitchen and bathrooms with the Landlord, who has lived in the house for ten years.
The ruling
The Landlord and Tenant Board determined that the Residential Tenancies Act, 2006 does not apply to this case. Because the Tenant shares a kitchen and bathroom with the owner (Landlord), the relationship is exempt from the Act under Section 5(i).
