What happened
The Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlords in good faith require possession of the rental unit for the purpose of residential occupation for at least one year. The Landlords also claimed compensation for each day the Tenant remained in the unit after the termination date.
The ruling
The Landlords' application is dismissed because they failed to disclose all prior N12 notices as required by the Act. The Landlords are ordered to serve a new N12 notice within 30 days, and the $759 paid to the Tenant prior to January 31, 2024 will be deemed as the required N12 compensation.
