What happened
Landlords sought to terminate tenancy and evict tenants for non-payment of rent. Tenants appealed LTB eviction order to Divisional Court. Landlords brought motion to quash tenants' appeal.
The ruling
The Divisional Court quashed the tenants' appeal of the LTB eviction order. The court found the appeal to be manifestly devoid of merit and an abuse of process, brought solely to delay eviction. The tenants were ordered to pay $2,500 in costs to the landlords.
