What happened
The Tenant requested a review of an LTB order that dismissed their application regarding an alleged illegal lockout and interference with vital services. The Tenant argued that the Landlord illegally locked them out on June 16, 2025, while the Tenant was in the process of filing an appeal to the Superior Court. The Sheriff had enforced an eviction order at 9:30 a.m. that morning. The Tenant contended that administrative delays at the courthouse should not invalidate the stay of eviction that an appeal is supposed to trigger.
The ruling
The request to review order LTB-T-050260-25 is denied. The original order, which dismissed the Tenant's claims of illegal lockout and interference with vital services, is confirmed. The Board found that the eviction was lawfully executed by the Sheriff before a legal stay was established by the Tenant's appeal process.
