What happened
The Landlords applied for termination of tenancy and eviction due to significant rent arrears. The Tenants, a mother and son, were joint leaseholders. Tenant 2 had vacated the unit a year prior and sought to be removed from the application, but the LTB held him jointly liable. Tenant 1 remained in possession and requested a delay in eviction due to her daughter's upcoming heart surgery and financial hardship.
The ruling
The tenancy is terminated effective December 31, 2025, unless the Tenants pay the full arrears to void the order. The Tenants are ordered to pay $26,500.60 if the tenancy is terminated, representing rent arrears up to the hearing date and the filing fee, minus the deposit and interest. If they wish to void the order and continue the tenancy, they must pay $35,286.00 by December 24, 2025, or $39,186.00 by December 31, 2025.
