What happened
The tenant appealed three 2016 Landlord and Tenant Board decisions, arguing they were unreasonable. The main issues were the landlord's entry to the rental unit on January 7, 2016, and the Board's refusal to set aside an earlier eviction order. The tenant claimed the entry was unreasonable and that the Board failed to consider accommodating his disability when deciding not to set aside the eviction order.
The ruling
The Divisional Court dismissed the tenant's appeal of the Landlord and Tenant Board's decisions. The court found no error of law in the Board's rulings regarding the landlord's entry to the rental unit or its decision not to set aside the eviction order. The stay on the eviction order was lifted, but enforcement was delayed until September 1, 2019.
