What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.

The ruling

The Board granted relief from eviction subject to a repayment plan. The tenants must pay $2,746 by October 16, 2023, and then $500 per month from November 2023 to April 2024, with a final payment of $38 on May 1, 2024. The tenants must also pay ongoing rent as it becomes due during this period. If the tenants fail to make any of the required payments, the landlord may apply to terminate the tenancy and evict the tenants.
