What happened
The Landlords applied for termination of the tenancy and eviction due to significant rent arrears. Tenant 1 attempted to raise maintenance issues regarding lack of heat and non-potable water under Section 82 of the Act. However, the Board ruled that the Tenants failed to comply with disclosure rules, as they did not provide evidence or notice of these issues seven days prior to the hearing. The Member found no serious ongoing breach of the Landlords' obligations and ordered the eviction while determining the arrears exceeded $16,000.
The ruling
The tenancy is terminated effective July 21, 2025, unless the Tenants pay $19,686.00 to void the order. If they do not pay and fail to vacate, the Landlord can enforce eviction starting July 22, 2025. The Tenants are ordered to pay $12,798.67 for arrears up to the hearing date plus daily compensation of $115.07 until move-out.
