What happened
The Landlord applied to evict the Tenants for non-payment of rent. A friend of the Tenants attended the hearing to request an adjournment due to one Tenant's cancer treatment. The request was denied because there was no prior notice, no supporting documentation, and the other Tenant's absence was unexplained. The Tenants also disputed the rent ledger but provided no evidence. The hearing proceeded with only the Landlord's evidence, resulting in a conditional eviction order.
The ruling
The tenancy is terminated unless the Tenants pay the outstanding amount according to a payment schedule extending to October 31, 2025. The first payment of $10,035.35 is due by May 31, 2025. If the Tenants fail to make the payments, they must vacate by October 31, 2025, and will owe the Landlord $2,515.51 plus daily compensation from May 2, 2025. The eviction is postponed to give the Tenants a chance to pay the arrears, a decision influenced by the Landlord's generous proposed timeline.
