What happened

The Tenant applied for remedies after the Landlord illegally disconnected electricity and heat, locked her out of the rental unit, and harassed her in an attempt to force her to vacate. The Tenant also cited unaddressed pest issues and maintenance concerns. The Landlord failed to attend the hearing despite being properly served. The Tenant sought rent abatement, compensation for out-of-pocket expenses, general damages, and an administrative fine against the Landlord.

The ruling

The Landlord is ordered to pay the Tenant a total of $8,810.87, which includes $5,000.00 for rent abatement, $757.87 for out-of-pocket expenses, $3,000.00 for general damages, and the $53.00 filing fee. Additionally, the Landlord must pay a $3,000.00 administrative fine to the LTB for egregious breaches of the Act. The Tenant is granted a 100% ongoing rent abatement until electricity and heat are restored. If the Landlord fails to pay by the deadline, the Tenant may deduct $750.00 from the monthly rent until the debt is satisfied.
