What happened
Tenants, who own a cottage and lease the underlying lot, applied for an order determining that the Landlord substantially interfered with their reasonable enjoyment and harassed them. The dispute centered on a late-night delivery of an envelope by the Landlord's agent and a significant increase in the annual fee for a parking space across from the cottage, which shifted from a flat rate to one including property taxes. The Tenants also cited a lack of communication from the Landlord's agent regarding a promised written lease.
The ruling
The Tenants' application was dismissed in its entirety. The Board found that the Landlord's actionsβdelivering an envelope at 10:00 p.m. and increasing parking fees with an itemized invoiceβdid not constitute harassment or substantial interference under the Residential Tenancies Act, 2006.
