What happened
The Landlord applied for eviction and rent arrears based on unpaid rent increases from 2023 and 2024. The Tenant contested the validity of the increases, claiming non-receipt due to mail theft and alleging retaliation for maintenance complaints. During the hearing, the Tenant abruptly disconnected and did not return. The Board found the rent increases valid but denied eviction, granting relief due to the small amount of arrears and the Tenant's history of consistent payments.
The ruling
The LTB found the Tenant owes $931.37 in arrears and costs but denied the Landlord's request for eviction. Instead, the Board granted relief from eviction and ordered the Tenant to pay the balance in monthly installments of $50.00 starting August 20, 2025, in addition to regular monthly rent. The Tenant's counter-claims for maintenance and harassment were dismissed.
