What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served a valid N4 notice. Despite receiving notice of the hearing, the Tenant did not attend. Evidence showed that while the Tenant made some payments after the application was filed, significant arrears remained. The Landlord attempted to negotiate a payment plan, but the Tenant did not respond.
The ruling
The tenancy is terminated effective November 7, 2025, unless the Tenant pays $4,387.02 by October 31, 2025, or $5,511.02 by November 7, 2025, to void the order. If the Tenant does not void the order and fails to move out, the Landlord may enforce the eviction through the Sheriff starting November 8, 2025. If the tenancy is terminated, the Tenant is ordered to pay the Landlord $2,751.95 plus daily compensation of $36.95.
