What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to rent arrears. The Tenant, a senior who had been living in the unit for nearly five years, explained that the arrears resulted from caring for his late father. While the Landlord expressed sympathy, they also highlighted the financial prejudice caused by the non-payment. The LTB member weighed these factors under Section 83 to determine if an eviction should be delayed.
The ruling
The tenancy is terminated effective November 30, 2025. The Tenant may void the order by paying $8,636.00 by October 31, 2025, or $10,036.00 by November 30, 2025. If the Tenant does not void the order and moves out, they are ordered to pay the Landlord $5,419.50, representing rent arrears up to the hearing date and the filing fee, minus the rent deposit and interest. Eviction enforcement is delayed until December 1, 2025, to provide the Tenant time to find alternative housing.
