What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served the Tenant with a valid N4 Notice, and the Tenant was still in possession of the rental unit at the time of the hearing. The Tenant stated that he wanted to move out and stopped paying rent in April 2022 due to lack of funds.

The ruling

The tenancy is terminated unless the Tenant pays $12,126 to void the order by March 24, 2023. If the Tenant does not pay, the Tenant must move out by March 24, 2023 and pay the Landlord $9,107.05, which includes rent arrears and the application filing fee, minus the rent deposit and interest.
