What happened
The Tenants requested a review of an order dated April 10, 2025, which terminated their tenancy for non-payment of rent. The Tenants claimed they did not receive notice of the original hearing and only learned of the eviction from a relative. They argued that mental health issues prevented one tenant from checking text messages. The Landlord provided evidence that the notice was mailed by the Board and hand-delivered by the Landlord's agent. The Board found the Tenants lacked due diligence in checking their mail.
The ruling
The Tenants' request for a review of the eviction order is denied. The original order issued on April 10, 2025, is confirmed and remains unchanged. The stay of eviction previously granted is lifted immediately, allowing the Landlord to proceed with enforcement.
