What happened

The Landlord applied to terminate the tenancy because the Tenant failed to meet conditions set in a previous LTB order from February 2025. An eviction order was initially issued without a hearing on June 10, 2025. The Tenant filed a motion to set aside this order, citing medical issues including hand surgery and a dental emergency that resulted in unexpected expenses and a missed June rent payment. The Landlord opposed the motion, noting it was the Tenant's second attempt to set aside an order and that the proposed payment plan was not financially viable.

The ruling

The Tenant's motion to set aside the eviction order is denied. The stay of the original eviction order (LTB-L-045260-25) will be lifted on September 29, 2025, giving the Tenant approximately one month to vacate the premises, as the Landlord did not oppose this extension.
