What happened

The Landlord applied to terminate the tenancy and evict the Tenants based on non-payment of rent, substantial interference with reasonable enjoyment, and alleged property damage. Before the hearing, the Tenants vacated the unit on July 6, 2025, and returned the keys, rendering the eviction request moot. The hearing focused on the rent arrears accumulated until the move-out date.

The ruling

The LTB ordered the Tenants to pay the Landlord $7,953.52 by August 22, 2025. This amount covers rent arrears up to the Tenants' move-out date of July 6, 2025, and the application fee, minus the last month's rent deposit and accrued interest. The eviction portion of the application was dismissed as the Tenants had already surrendered possession.
