What happened
The Landlord applied for eviction and rent arrears. The Tenant raised a preliminary motion claiming she was a licensee and not a tenant, which was dismissed based on issue estoppel from a previous LTB ruling. The Tenant also claimed she paid all rent in cash using a 'porch light signal' system, but provided no documentary evidence (receipts or bank statements). The Board found the Landlord's testimony more credible and determined that the Tenant owed significant arrears.
The ruling
The tenancy is terminated effective June 30, 2025. The Tenant must pay $15,520.87 to the Landlord to cover arrears up to the hearing date and the application fee. To void the eviction and continue the tenancy, the Tenant must pay $16,986.00 by June 30, 2025. Daily compensation of $46.03 applies from June 5, 2025.
