What happened

The Landlord applied to terminate the tenancy because he required the basement unit for his son's residential occupation. The Tenant did not attend the hearing. The Landlord's son provided evidence of his genuine intention to move into the unit with his spouse for at least one year to seek privacy from the main floor where they currently reside with the Landlord. The Board found the application was made in good faith.

The ruling

The tenancy is terminated effective January 17, 2026. The Tenant is ordered to pay $1,723.09 to the Landlord, which accounts for daily compensation for overstaying the termination notice, minus the rent deposit and accrued interest. If the Tenant does not vacate, the Landlord may enforce eviction through the Sheriff starting January 18, 2026.
