What happened

The Landlord applied to terminate the tenancy because the Tenant substantially interfered with the Landlord's reasonable enjoyment by repeatedly contacting the Landlord directly instead of using the established property management portal. Despite being served a first voidable N5 notice, the Tenant continued the direct contact, leading to a second non-voidable N5 notice. The Landlord sought a conditional order to enforce the communication protocol.

The ruling

The LTB ordered that the tenancy shall continue on the condition that the Tenant directs all property-related communications solely to the property management company via the specified email (TENANT@LIMESTONEPM.CA). If the Tenant breaches this condition, the Landlord may apply for an ex parte eviction order within 30 days of the breach. The eviction part of the order expires on November 25, 2025.
