What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant failed to void the N4 notice by paying the arrears before the application was filed and did not attend the hearing. Evidence showed the Tenant has not made any rent payments since May 2025, and the arrears have doubled since the application was initially filed.

The ruling

The LTB ordered the termination of the tenancy effective September 16, 2025, unless the Tenant voids the order by paying $5,500.90 (which includes rent up to September 30, 2025). If the Tenant does not pay and does not move out, the Landlord can enforce the eviction through the Sheriff starting September 17, 2025. If the tenancy is terminated, the Tenant is ordered to pay the Landlord $3,217.85 plus daily compensation of $34.95 until they vacate.
