What happened

The Landlord obtained an eviction order without a hearing after the Tenants allegedly breached a condition of a previous LTB order from February 2025. Tenant 1 filed a motion to set aside that eviction order on behalf of all Tenants. During the motion hearing, Tenant 1 admitted to the breach of the previous order but requested that the stay of eviction be lifted on August 31, 2025, essentially seeking more time to move out. The Landlord failed to attend the hearing despite being served.

The ruling

The Tenants' motion to set aside the eviction order (LTB-L-044364-25) is denied. However, the stay of that eviction order is lifted effective August 31, 2025. This means the original eviction order remains valid but the Landlord cannot enforce it through the Court Sheriff until September 1, 2025.
