What happened
The Landlord applied for eviction and rent arrears. The Tenant admitted to non-payment but disputed the lawful rent amount, claiming a portion was for utilities and that he was owed credits. The Tenant also attempted to raise maintenance issues at the hearing without prior notice or a formal application, which the Board declined to hear. The Tenant cited financial strain due to supporting his son's medical treatment but did not provide a realistic payment plan.
The ruling
The tenancy is terminated effective January 15, 2026. The Tenant must pay $4,446.68 (arrears minus deposit) to the Landlord if the unit is vacated. To void the eviction and continue the tenancy, the Tenant must pay $13,286.00 by December 31, 2025, or $16,286.00 by January 15, 2026.
