What happened
The Landlords applied to terminate the tenancy based on non-payment of rent and the purchaser's requirement for the unit for residential occupation. A complex legal issue arose following the death of the original tenant, where the occupant (the tenant's partner) was deemed to have been assigned the tenancy because the Landlords failed to file an unauthorized occupant application within the statutory 60-day period.
The ruling
The tenancy is terminated effective December 29, 2025. The Estate of the Former Tenant is ordered to pay $6,548.44 in arrears. The current Tenant is ordered to pay $3,056.76, which includes rent arrears from the date of the deemed assignment and the application filing fee. The Landlord is granted an eviction order as the unit is required for the purchaser's own use.
