What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to pay utility costs, smoking inside the rental unit, and causing damage to the property. The Landlord served the Tenant with an N5 notice of termination, but the Tenant did not void the notice.
The ruling
The tenancy continues, subject to the Tenant paying outstanding utility bills, maintaining current utility payments, and not smoking inside the rental unit. If the Tenant fails to comply with these conditions, the Landlord may apply to terminate the tenancy.
