What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. A valid N4 notice was served, but the Tenants failed to pay the full arrears. Although the Tenants made a payment of $5,474.99 after the application was filed, a balance remained. The Tenants did not attend the hearing despite being properly served.
The ruling
The tenancy is terminated effective November 9, 2025, unless the Tenants pay $3,874.03 by October 31, 2025, or $5,722.70 by November 9, 2025, to void the order. If they do not void the order and fail to move out, the Landlord may enforce eviction. In the event of termination, the Tenants owe the Landlord $1,339.57 plus daily compensation of $60.78 from October 24, 2025.
