What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to persistent late payment of rent. The Landlord served a valid N8 notice, and the Tenant was in possession of the rental unit on the date the application was filed.
The ruling
The tenancy is terminated effective May 21, 2023. The Tenant must vacate the rental unit by this date. If the unit is not vacated, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant must pay the Landlord $5,605.57, which represents compensation for use of the unit from September 1, 2022 to April 5, 2023, less the rent deposit and interest owed on the deposit. The Tenant must also pay the Landlord $44.05 per day for use of the unit from April 6, 2023 until the Tenant moves out, as well as the $186 application filing fee.
