What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had remained in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on September 30, 2024 unless the tenant pays $12,065.37 by August 31, 2024 or $13,326.12 by September 30, 2024 to void the order. If the tenant does not void the order, they must pay $6,617.50 to the landlord and vacate the unit by September 30, 2024. The landlord is entitled to compensation of $41.45 per day for the tenant's continued occupation after the hearing date.
