What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and persistent late payment of rent. The Tenant paid all outstanding rent prior to the hearing, but the Landlord proceeded with the application for persistent late payment.

The ruling

The Landlord's application for non-payment of rent is discontinued as the Tenant paid all outstanding rent prior to the hearing. However, the Landlord's application for persistent late payment of rent is granted. The tenancy will continue if the Tenant pays the rent on time for the next 24 months. If the Tenant fails to comply, the Landlord may apply to terminate the tenancy without notice to the Tenant. The Tenant must also pay the Landlord's $186 filing fee.
