What happened
The Landlords applied for termination of tenancy and eviction due to non-payment of rent. The Tenants, who are family members of the Landlords, claimed there was a verbal agreement to reduce the rent to $1,000.00 per month due to financial hardship and argued that a previous rent increase in 2020 was illegal. The Landlords contended that they only accepted partial payments temporarily and never agreed to a permanent rent reduction. The Board found the 2020 rent increase lawful due to the passage of time and ordered the Tenants to pay the arrears or face eviction.
The ruling
The tenancy is terminated effective July 29, 2025, unless the Tenants pay $22,186.00 to void the order. If the Tenants do not pay and do not move out, the Landlords may enforce the eviction through the Sheriff starting July 30, 2025. The Tenants are ordered to pay $19,710.42 representing arrears to the hearing date and the application fee, plus daily compensation of $59.18 until they vacate.
