What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant admitted that the tenancy was no longer viable due to his personal financial situation, including employment issues and monthly expenses. While the Landlord faced financial stress from the lack of rental income, the Tenant requested an extension of the eviction date to find a new residence. The adjudicator granted the eviction but postponed the date to the end of the year to balance the impact on the Tenant against the financial prejudice to the Landlord.
The ruling
The tenancy is terminated effective December 31, 2025. The Tenant is ordered to pay $7,171.96 representing arrears up to the hearing date and the filing fee, after deducting the rent deposit and interest. To void the eviction and continue the tenancy, the Tenant must pay $12,386.00 by November 30, 2025, or $15,211.00 by December 31, 2025. Daily compensation of $92.88 applies for each day the Tenant remains in the unit starting November 6, 2025.
