What happened
The Landlord applied to terminate the tenancy because the Tenant had been persistently late in paying rent. Evidence showed the Tenant was late 12 out of 13 months between May 2024 and May 2025, and continued to be late for five months following the application. The Tenant, an eight-year resident, requested relief from eviction, citing a slowdown in the construction industry affecting his income but expressing a commitment to future timely payments.
The ruling
The application for eviction is denied on the condition that the Tenant pays the full monthly rent on or before the 1st of each month for 12 months, starting January 1, 2026. If the Tenant fails to pay on time, the Landlord may apply for an ex parte eviction order under Section 78. Additionally, the Tenant must pay the $186.00 application filing fee to the Landlord by December 21, 2025.
