What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to persistent late payment of rent. The Landlord provided evidence that the Tenant was late 13 out of 13 times between May 2024 and May 2025. The Tenant argued that his financial situation was improving after a summer slowdown in employment and disputed the lawful rent amount based on a previous LTB order.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenant pays full monthly rent on or before the 1st of each month for 12 months (January 2026 to December 2026). The Tenant is also ordered to pay the $186.00 filing fee by December 21, 2025. If the Tenant misses a payment, the Landlord may apply for an eviction order without notice.
