What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. Despite receiving notice of the hearing, the Tenants did not attend. The Landlord provided evidence of significant arrears and stated that the Tenants had not responded to attempts to negotiate a repayment plan. While the Tenants made some payments after the application was filed, the arrears continued to grow.

The ruling

The tenancy is terminated effective July 29, 2025, unless the Tenants pay $5,116.19 to void the order by that date. If the Tenants do not void the order and fail to move out, the Landlord can enforce the eviction through the Sheriff starting July 30, 2025. The Tenants are ordered to pay $2,399.23 to the Landlord for arrears and filing fees (after accounting for the deposit and interest), plus daily compensation of $60.87 for each day they remain in the unit after July 3, 2025.
