What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to rent arrears. During the hearing, it was determined that the Landlord's N4 notice was defective as it did not provide the required 14 days' notice. Consequently, the request for eviction was denied, and the Landlord sought an order for rent arrears only.

The ruling

The LTB denied the Landlord's request for eviction because the N4 notice was defective. However, the Tenants are ordered to pay the Landlord $3,976.00, representing rent arrears up to October 31, 2025, and the application filing fee. If payment is not made by November 25, 2025, interest will accrue at 4.00% annually.
