What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant requested an adjournment based on medical grounds (high blood pressure), which was denied due to an insufficiently detailed medical note. The Tenant also disputed the existence of a last month's rent deposit and attempted to raise maintenance issues (Section 82), which were excluded due to lack of prior notice. The Landlord demonstrated significant financial hardship resulting from the arrears.
The ruling
The tenancy is terminated effective December 9, 2025. The Tenant is ordered to pay the Landlord $19,827.00 for arrears up to the hearing date and the filing fee. The Tenant may void the eviction by paying $20,786.00 by November 30, 2025, or $23,586.00 by December 9, 2025. Daily compensation of $92.05 is required for each day the Tenant remains in the unit after November 20, 2025.
